Commercial litigation and class actions
Commercial litigation and class actions
Brinkhof represents clients in complex civil litigation going to the heart of their business, across a range of industries with a specific focus on technology and media. We handle matters across a broad range of sector-specific issues including allegations of competition-law infringement, privacy and data-protection issues, platform regulation and intermediary liability.
To us, these cases are not just “litigation” – we thrive on them because they call for deep industry knowledge and affinity with digital products and services. Brinkhof lawyers have been defending technology companies before Dutch courts for two decades, with over 100 published judgments. We do not distinguish subject-matter experts from litigators but staff each case with multi-disciplinary teams of lawyers who are used to working side by side.
A Bold, Strategic and Results-Oriented Approach
Our approach is characterized by bold procedural choices, rigorous strategic thinking, and a clear focus on achieving results. We identify and pursue the arguments most likely to bring proceedings to an early end or limit their scope, and we are not afraid to adopt innovative approaches and challenging positions.
We have a proven track record of successfully defending clients at the admissibility stage of collective action proceedings, including obtaining the first ruling in Dutch GDPR class-action history where a claim vehicle’s claims failed to meet the WAMCA commonality requirement.
International Coordination
Class actions and other commercial litigation proceedings targeting technology companies rarely arise in a single jurisdiction. We work closely with lead counsel and local firms across relevant jurisdictions, aligning Dutch proceedings with a broader litigation strategy while ensuring that every available procedural argument under Dutch law is identified and pursued. We are as comfortable helping set international strategy as we are executing it before the Dutch courts.
Supreme Court litigation
Brinkhof also has a Supreme Court litigation practice. Partner Jan Pot has acted in over a dozen cases before the Supreme Court of the Netherlands and has never lost defending a case before the Supreme Court. Our Supreme Court practice covers all aspects of IP, tech and media law, including patent law, trademarks and designs, privacy and data protection, and internet intermediary liability.
