Marthe van der Velde

Lawyer

Marthe is a lawyer at Brinkhof, specializing in media law, intermediary liability, and information law. In her daily practice, she advises and litigates on a wide range of legal issues related to (online) freedom of information, platform regulation and copyright (contract) law, and artificial intelligence. Having been seconded as Legal Counsel at Google, Marthe has developed a strong understanding of the perspective of a technology company.

Experience & ancillary activities

Marthe has published several articles on copyright-related topics, ranging from issues involving artificial intelligence to authors’ contract law. She also co-authored the NJB chronicle ‘Technology and Law’. In addition, Marthe is a member of the Dutch Copyright Law Association and the Netherlands Association for Information Technology and Law. She is also active as a volunteer for Lawyers for Lawyers.

Marthe graduated in 2021 from Utrecht University with a master’s degree in Public International Law, specializing in human rights, and a master’s in Private Law, with a focus on intellectual property law. She also studied a semester in Lund (Sweden) and assisted in various research projects at Utrecht University at the intersection of law and technology. Marthe was admitted to the bar in 2021.

Some of the cases Marthe van der Velde has handled:

  • Advising various clients on recent European regulations concerning platform governance and online intellectual property rights, such as the Digital Services Act, the Platform to Business Regulation, and the revised Copyright Directive.
  • Litigating cases involving the “right to be forgotten” from search engine results.
  • Representing various online platforms in disputes over content moderation decisions.
  • Advising on authors’ contract law and both European and national media regulation, including protection of minors.
  • Advising on negotiations with collective management organizations and, where necessary, litigating issues related to collective rights management, audiovisual copyright, and neighbouring rights.
