Ex Parte Injunction Upheld

Early 2018 Brinkhof obtained an ex parte injunction based on a patent for roadside crash cushions. The injunction was enforced during a trade fare in Amsterdam and goods were seized to stop the infringement of the patent. The injunction was subsequently contested in court without success. The court deemed the patent valid and infringed.

Ex parte injunctions based on patents are a rare phenomenon in the Netherlands. Ex parte injunctions are not often granted, let alone upheld in subsequent proceedings.
