Court reduces multi-million fine telecom providers
On 5 February 2021, the District Court of Rotterdam decided on the appeal by telecom providers KPN, VodafoneZiggo, T-Mobile and Tele2 against the fine imposed on them by the Authority for Consumers and Markets (ACM). Although the Court was of the opinion that the telecom providers could be held responsible, the Court found the fines to be disproportionate. The ACM should have provided a better reasoning and the fines should have been tailored more to the individual cases. The Court therefore applied a 40% discount instead of the original 25%.
