Court of Justice provides guidance on local levies paid for the construction of fiber network
Pepijn van Ginneken wrote a commentary on the judgment of the Court of Justice of 30 January 2018 concerning the construction of glass fiber internet networks. The Court ruled that the high levies local authorities charge for the construction of fiber networks are incompatible with the European Authorisation Directive. This directive requires such levies to amount to the necessary costs only. Because of this judgment, local authorities will no longer be able to charge high levies from operators for the construction of fiber networks within their territory.
