Belmio coffee cup does not infringe patent Douwe Egberts

Belmoca as well as Douwe Egberts produce coffee cups that are compatible with Nespresso machines; Belmoca under the brand Belmio and Douwe Egberts under the brand L’Or.

Douwe Egberts has a patent on aluminium coffee cups for which deformations in the rim of the cup provide for the sealing with the coffee machine. The preliminary injunction judge of the Hague District Court ruled that it is unlikely that Belmoca infringes the Douwe Egberts patent. If the patent would be infringed, than it is invalid for lack of novelty.
